On September 14th, the Environmental Protection Agency (EPA) announced an alarming new proposal that would further roll back federal protections against climate pollution from fossil-fuel power plants. Docket: EPA-HQ-OAR-2025-0124
This action would not only repeal most of the Biden-era limits on greenhouse-gas emissions from power plants, but it would also establish the EPA’s position that greenhouse-gas emissions from fossil-fuel power plants do not contribute significantly to dangerous air pollution under the Clean Air Act. If finalized, that interpretation would significantly constrain EPA’s ability to regulate power-sector climate pollution under the law in the future.
Sadly, we’ve been here before.
The largest source of pollution in the U.S. comes from cars. In February of this year, the EPA dismantled the key vehicle emissions regulations setting greenhouse gas standards for cars. The Trump administration rescinded the “endangerment finding” which is the legal determination obligating the EPA to regulate climate pollutants.
The consequences of this mean that manufacturers no longer face federal requirements to measure, control, or report on greenhouse gas emissions for highway vehicles.
How can we protect our clean air and water?
The EPA is expected to open a 45-day public comment period after the proposal is published in the Federal Register. We know that many of Care2’s environmental clients will want to engage on this issue, including by submitting public comments to the docket. Care2 was able to deliver 722,000 comments to the EPA over a 60-day period during the Biden Administration.
